Bluejay Terms of Service

Welcome to Bluejay. These Terms of Service ("Terms") govern your access to and use of the Bluejay platform, website, and related services (collectively, the "Platform").

By creating an account or using Bluejay, you agree to these Terms.

If you do not agree, do not use the Platform.

1. About Bluejay

Bluejay is a community marketplace that connects parents with independent sitters.

Bluejay is not an employer of sitters and does not provide childcare services. Bluejay does not supervise, direct, or control the services provided by sitters.

All childcare services are arranged directly between parents and sitters.

2. Eligibility

To use Bluejay:

  • Parents must be at least 18 years old.
  • Sitters must be at least 13 years old.
  • No one under 13 may create an account.

If a sitter is under 18, their parent or legal guardian must create a linked account and agrees to these Terms on the minor's behalf. The guardian is responsible for the minor's activity on the Platform.

By using Bluejay, you represent that you meet these eligibility requirements.

3. Nature of the Platform

Bluejay is a technology platform that facilitates introductions between parents and sitters.

Bluejay:

  • Does not verify sitter identity, age, qualifications, or experience.
  • Does not conduct background checks.
  • Does not interview sitters.
  • Does not guarantee the safety, quality, or legality of services.
  • Does not supervise in-person interactions.

Parents are solely responsible for evaluating sitters before booking. Sitters are solely responsible for evaluating families before accepting bookings.

Any decision to engage in services is made at your own discretion and risk.

4. Payments and Subscription Fees

Annual Parent Subscription

  • Parents are charged a flat annual platform fee for access to Bluejay.
  • The subscription provides access for one year from the date of purchase.
  • Parents may cancel at any time.
  • Cancellation stops renewal but does not terminate access until the end of the paid subscription period.

Refunds are handled at Bluejay's discretion.

Payments Between Parents and Sitters

  • Bluejay does not employ sitters and does not directly pay sitters.
  • Payment for childcare services is arranged between parents and sitters. Stripe may process certain transactions in connection with subscription fees.
  • Bluejay is not responsible for disputes regarding compensation for childcare services.

5. Cancellations and No-Shows

If a parent or sitter cancels a booking, the other party will be notified.

No automatic monetary penalties apply through the Platform.

Repeated cancellations or no-shows may result in:

  • Poor ratings
  • Account flagging
  • Suspension or removal from the Platform

Bluejay reserves the right to review and act on patterns of misuse.

6. Ratings and Reviews

  • Users may leave ratings or reviews based on their experiences.
  • Reviews must be honest and not defamatory, abusive, or misleading.
  • Bluejay may remove reviews that violate these Terms.

7. Safety and User Conduct

Bluejay operates as an invite-only community for parents. While we take steps to encourage a safe environment, we do not guarantee safety outcomes.

You agree not to:

  • Harass or threaten other users
  • Provide false information
  • Impersonate another person
  • Use the Platform for illegal purposes
  • Attempt to bypass safety features
  • Scrape or copy platform data
  • Interfere with platform functionality

You agree that in-person interactions occur at your own risk.

If you experience safety concerns, you should contact local authorities where appropriate.

8. Account Suspension and Termination

Bluejay may suspend or terminate any account at its discretion, including for:

  • Safety concerns
  • Repeated cancellations or no-shows
  • Violations of these Terms
  • Harmful or inappropriate conduct

Accounts flagged as unsafe may be reviewed immediately and suspended pending investigation.

Bluejay is not required to provide advance notice of suspension.

9. Minor Sitters

If a sitter is under 18:

  • A parent or guardian must maintain a linked account.
  • The guardian accepts these Terms on behalf of the minor.
  • The guardian is responsible for monitoring the minor's activity.
  • The guardian assumes responsibility for the minor's participation and conduct.

10. Intellectual Property

The Bluejay Platform, including its design, branding, logos, and content, is owned by Bluejay.

Users retain ownership of content they post (such as profile photos, messages, and reviews), but grant Bluejay a non-exclusive, royalty-free license to display, store, and use that content for operating and improving the Platform.

You may not copy, modify, or distribute Bluejay's proprietary materials without permission.

11. Disclaimer of Warranties

The Platform is provided "as is" and "as available."

Bluejay makes no warranties, express or implied, including:

  • Fitness for a particular purpose
  • Safety or reliability of users
  • Availability or uninterrupted access

Bluejay does not guarantee that any user is trustworthy, qualified, or appropriate.

12. Limitation of Liability

To the maximum extent permitted by law:

Bluejay shall not be liable for:

  • Any injuries or damages arising from in-person interactions
  • Conduct of parents or sitters
  • Loss of data
  • Indirect, incidental, or consequential damages

Bluejay's total liability for any claim shall not exceed the amount of subscription fees paid by the parent in the preceding 12 months.

13. Indemnification

You agree to indemnify and hold harmless Bluejay from any claims, damages, losses, or expenses arising from:

  • Your use of the Platform
  • Your interactions with other users
  • Your violation of these Terms

14. Governing Law

These Terms are governed by the laws of the State of California.

Any disputes shall be resolved in the state or federal courts located in California.

You agree to submit to the jurisdiction of those courts.

15. Changes to These Terms

Bluejay may update these Terms from time to time.

We will update the Effective Date when changes are made.

Continued use of the Platform after changes means you accept the updated Terms.
